Terms of Use
The short version. August 365 Toolkit makes real changes in your production Microsoft 365 tenant: it can disable and delete accounts, remove licenses and change group and mailbox settings. You are responsible for what you choose to run, and the software comes without warranty. Read each action before you confirm it.
These terms govern your use of the August 365 Toolkit desktop app and any updates (“the Software”) and of outsidecontextsoftware.com (“the website”). The Software and website are provided by Outside Context Software LLC, a Texas limited liability company (“we”, “us”). By installing or using the Software you agree to these terms. If you do not agree, do not use it.
1. License
Subject to these terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software to administer your own organization’s Microsoft 365 environment, within the scope of the license you purchased (for example, the number of administrators or installs stated at purchase). We keep all rights not expressly granted. The Software is licensed, not sold.
You may not, except where the law or a written agreement with us allows: sell, resell, rent, sublicense or distribute the Software; remove or alter copyright or other notices; or use it to provide services to third parties beyond what your license states.
2. You are responsible for your tenant
- The Software acts in your tenant using the permissions you or your administrator grant to its app registration. You are responsible for granting only what you are comfortable with, and for having authority to administer the tenant you connect it to.
- Some actions cannot be undone, or can only be put back by hand. Each tile’s built-in help says what it changes and what can and cannot be undone. Read it, review the summary and confirmation before you run an action, and keep your own backups and records.
- You are responsible for protecting the app’s credentials, renewing expiring secrets or certificates, and for who in your organization can use the Software.
- The Software records the changes it makes in an audit log on your PC or team folder. Keeping and protecting that log is up to you.
3. No warranty
The Software and website are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the Software will be error-free, uninterrupted, or will not change your tenant in ways you did not intend. Microsoft services change over time and may stop working with the Software without notice.
4. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue, goodwill or business, or for service interruption or any changes, deletions or disclosures in your tenant, arising from or related to the Software or website, even if we have been advised of the possibility. Our total liability for any claim is limited to the amount you paid us for the Software in the twelve months before the claim arose.
Some places do not allow certain exclusions or limits, so parts of this section may not apply to you.
5. Microsoft and other services
Microsoft, Microsoft 365, Entra, Exchange, Teams, SharePoint, OneDrive, Azure and Purview are trademarks of the Microsoft group of companies. We are not affiliated with, endorsed by or sponsored by Microsoft. Your use of Microsoft services is governed by your own agreements with Microsoft. Purchases are processed by Gumroad under Gumroad’s terms.
6. Updates and support
We may provide updates, and support by email at support@outsidecontextsoftware.com, on a reasonable-efforts basis. We do not guarantee response times or that any particular feature will continue to be offered.
7. Purchases and refunds
Prices and any refund terms are stated on the page where you buy the Software and apply to that purchase.
8. Pre-release software
While the Software is marked pre-release, it may contain defects and change between versions. Use it first on a test tenant where you can.
9. Ending the license
The license ends automatically if you breach these terms. You may stop using the Software at any time. When the license ends you must stop using the Software and delete your copies. Sections 2, 3, 4 and 11 continue after it ends.
10. The website
The website is for information and is provided as is. Its content may be out of date, and nothing on it is professional, legal or security advice.
11. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, and you and we consent to their jurisdiction.
12. Changes
We may update these terms. Updated terms apply to versions of the Software released after the effective date shown above, and to the website from that date.
